A Florida-based company that makes Mac clones has upped the ante in its ongoing copyright litigation against Apple. In its latest claim in U.S. District Court in San Francisco, Psystar claims that Apple has injected code into a version of its Mac OS X software that makes it impossible for unauthorized third-party computers to run the operating system. That action is itself a violation of copyright law, the argument goes. It's a classic "copyright misuse" legal strategy, said Chris Collins, an intellectual property attorney with Vanderpool, Frostick & Nishanian.

Apple is facing two more legal challenges against the iPhone. Los Angeles-based
EMG Technology filed a suit in the U.S. District Court in Texas claiming that the iPhone infringes on a patent approved last month by the Patent and Trademark Office. The patent is for an "apparatus and method of manipulating a region on a wireless device screen for viewing, zooming and scrolling Internet content."

Psystar's chief legal defense in its fight with Apple is off the table -- for the moment at least. U.S. District Judge William Alsup has dismissed charges that Apple is violating antitrust regulations and creating restraint of trade by linking its operating system with its branded hardware.

Apple's move to shake up its iPod and iPhone management team has been put on hold. A federal court judge on Friday granted a preliminary injunction requested by IBM that ordered Mark Papermaster to cease working for Apple until further notice. Apple hired Papermaster away from IBM last month to head hardware engineering for its handheld gadgets.

A former IBM executive is going against the company's wishes and joining Apple. Mark Papermaster, previously vice president of IBM's blade server unit, will become head of the iPod and iPhone development team, Apple has confirmed. IBM has already filed a lawsuit to try to stop his hire.

In the wake of continuing reports of 3G connectivity problems from an unknown percentage of iPhone 3G users, one Alabama woman has had enough: Jessica Alena Smith has reportedly filed a complaint against Apple and is seeking class action lawsuit status. The suit alleges that the iPhone 3G did not provide twice the speed as promised by Apple in the company's "Twice as fast. Half the price" marketing messages.
